1. Who is the data controller in respect of your personal data?

The data controller in respect of your personal data is JT International Iberia, S.L.U. (“JTI”), Spanish Tax ID (NIF) number B-81591265 and having its registered offices at Paseo de la Castellana, n.º 66, 1ª planta, 28046, Madrid.


2. Personal data to be processed by JTI within the framework of the Ploom Crew Platform

All personal data collected through the Ploom Crew platform, which can be found at www.ploomcrew.es (the “Platform”), will be processed as set forth below. In this regard, JTI will collect and process the following categories of personal data, among others:

• Identifying data (name and surname) and, on a voluntary basis, a photograph or image of you, if you decide to share one via the Platform.

• Contact details (corporate email address).  

• Information obtained through cookies and similar technologies. Further details on the information we obtain through cookies and similar technologies can be found in our Cookie Policy. 

• On a supplementary and voluntary basis, other personal information may be requested when taking part in certain activities featured on the Platform or if you choose to complete surveys.


JTI will likewise process the personal data of any third parties outside JTI who decide to take part in Ploom Crew in order to benefit from the Promotion.


3. Finalidades y bases de legitimación del tratamiento de sus datos personales

(i) To manage and perform the contractual relationship entered into following your registration as a user on the Platform and your acceptance of the legal terms and other applicable terms and conditions, so that you may take part in the internal promotion known as Ploom Crew 2024 (“Ploom Crew”).  

The foregoing may include: (a) carrying out any formalities and procedures necessary to ensure the proper development, maintenance and monitoring of the contractual relationship and your participation, as the case may be, in Ploom Crew; (b) processing and responding to your queries, suggestions and complaints within the framework of the promotion; and (c) sending notifications related to Ploom Crew and your participation therein.

The lawful basis is the performance of the terms and conditions of the Platform and/or the Promotion. 

(ii) We may also send further communications regarding Ploom Crew to your email address so as to ensure that you do not miss any important or useful notifications about Ploom Crew or the Promotion, based on JTI's legitimate interest in properly managing Ploom Crew and enabling you to take part in the Promotion. 

In any case, you will have the option to oppose (opt-out) the sending of these communications at any time by using the mechanisms indicated in each such communication. You may also do so via the Platform.

(iii) Where appropriate and always with your consent, your image may be posted on the Platform in connection with any of the Ploom Crew games. This consent shall be understood as freely given at the time you voluntarily decide to upload your image or photograph to the Platform.


4. Disclosure of your personal data

4.1. Recipients of your Personal Data

Third-party service providers (e.g. entities tasked with organizing Ploom Crew, or those responsible for developing and running the Platform) will have access to your personal data if they need to access and process such data, on JTI’s behalf, as a result of the services they provide. In all such cases, they shall act as data processors.

4.2. International transfers of personal data to third countries or international organizations 

There will be no international transfers of your personal data.  


5. Retention of your Personal Data  

Your personal data will be retained for the purposes indicated herein (i) until the completion of Ploom Crew, if you have chosen to take part, or until you decide not to remain registered on the Platform; (ii) until you exercise your right of objection to processing at any time by clicking on the unsubscribe link contained in the email sent to you; and (iii) until you withdraw your consent, at any time, without this affecting the lawfulness of any processing activity carried out up until your withdrawal. Once these periods have elapsed, your personal data will be retained, duly blocked, over the limitation period in respect of JTI’s legal obligations and any further liability that may arise in connection with the processing of such data.


6. Exercise of Rights 

You may, at any time, exercise your rights of access, rectification, erasure, objection to processing, restriction of processing and portability with respect to your personal data, as well as revoke your consent, by writing to the following e-mail address: datos-personales@jti.com. Note that doing so will not affect the lawfulness of any processing activity carried out prior to your withdrawal.
